Here is another weird crime and justice article:  The Fire Arts Festival that was held in the 1200 block of Seventh Street is where two women were leaving and returning to their vehicle when they were accosted and robbed. In connection with this robbery and assault one man has been arrested and police are seeking two other people that were involved in the incident. By the way you can finfd additional legal and national headline news stories over at the Merlin News Weblog  ………Over there you can find a plethera of news stories and editorials from the unique viewpoint of Merlin himself. Alright now back to the story that could easily find itself mentioned on Jay Leno’s stupid criminal segment:

According to reports statements from Police Officer Jason Andersen the women were leaving the Fire Arts Festival at approximately 12:15 a.m. when they were approached and threatened by what has been found to be a toy gun. The women whose identities have not been released other than their ages of 56 and 65. The women were in the 700 block of Union Street when three men that are known of approached them, one man told the 56 year old woman he wanted her backpack while holding a gun. The woman refused, the man grabbed the backpack and the woman was thrown to the ground. As the man reached for the backpack the gun fell, the woman grabbed the gun and at this time realized it was a toy plastic gun. The man commanded that she return the gun, which she did, during the time that this took place another man grabbed the 65 year old woman’s purse and threw her to the ground.

During these events the women were screaming for help and when the robbers left on foot. Two police officers that were in the vicinity of Union Street and 8th Street heard the calls for help. Upon hearing the incident perused the men they had seen walking away from the scene, the two officers have been identified as Officer Michael Mack and Officer David Chapman.

Along with other officers one of the suspects were found in a yard and the backpack was found near by, this man has been identified as Derrick Turner age 39 and he was identified by the victims. Turner was arrested for an alleged two counts of armed robbery.

The toy gun has not been found and the victims who had lost bankcards and credit cards have had some of the items found when Turner was apprehended.

Legal Criminal news out of Portland, Oregon

Filed under: Legal news — @ 11:56 pm

A bill in Oregon that has been proposed for vehicular homicide in cases where drivers are involved in bicycle accident that ends with a fatality.
One of the people who feel this is a necessary law is Mary O’Donnel, the wife of a bicycle rider who was killed approximately a year ago while riding his bike. O’Donnel it is reported explained her support for this bill due to the fact that the driver who struck and killed her husband was a driver from out of state driving a rental car with a suspended drivers license. This unlicensed driver received a fine as a punishment for the accident.
This law would hold drivers responsible when they drive under the influence, with a suspended drivers license or with no car insurance, by possibly facing vehicular homicide charges.
O’Donnel as well as biking clubs supports the new law and advocates who want to see the law go into effect holding drivers responsible. They believe this proposal needs to be put into effect enough that O’Donnel held a news conference to discuss the new bill and the fact that she is hoping to get a sponsor to introduce the bill in the 2009 session. She also has plans to bring a lawsuit against the unlicensed driver who was involved in the accident with her husband that would be celebrating his 50th wedding anniversary.

By the way if you reside in Portland and you require excellent legal representation then retaining a Portland Criminal Defense lawyer can make all the difference to a good outcome in your case. The criminal defense attorney will make sure you are given all your constitutional rights. Might I recommend in this case Bruce Shepley if you are charged with criminal offenses in and around Oregon City and Portland, Oregon, including Clackamas and Multnomah Counties. He is an outstanding Criminal defense lawyer.
Should this bill be introduced into law drivers who are involved in bicycle accidents that end in a fatality will need the services of Oregon criminal defense trial attorney when it is time for their case to be hear to ensure that they have their case argued aggressively.
All in all, Oregon has seen a major spotlight shone on legal issues as of late, especially measure 11. This particular measure revolves around having
a mandatory sentence for each charge that it is tried under these sentencing guidelines.  In other words, a defendant who is not properly represented may feel the full effect of the sentencing in their criminal trial and with more than one charge that qualifies to be tried.  Therefore, if Measure 11 is implemented that individual could recieve even more than a life sentence. It would therefore be even more important than ever to be represented properly by a lawyer with extensive experience and knowledge of the applicable laws so that a substantial amount of time in jail might be avoided.

Sam Lincoln Gets Years Added

According to family and friends Samuel Kingman Lincoln stated his addiction to meth is what created the problems for the man that has been sentenced to a total of 332 years in prison. This is because of his violent crimes that have changed the life of this 27 year old that in his boyhood was named as the Peach King twice and rode in the lead of the Palisade’s Peach Festival.

Lincoln’s most recent criminal conviction (man does this guy keep his attorney busy or what) was an attempted murder for using a bayonet to stab a man, which he then robbed his trailer. The judge District Chief Judge James Boyd in Lincoln sentenced him to 90 years in that crime, which took place in 2004 in West Glenwood. Lincoln in a statement to the court said that he hopes that this case will be dismissed in the future, as he did not participate in this crime.
The Deputy District Attorney Amy Fitch had requested the court give the maximum sentence, which was 117 years commenting this was one of the worst crimes she had seen. Attorney Fitch also said that Lincoln is not safe to live in society.
Lincoln’s attorney Kathy Gourdy had requested a ten-year minimum sentence. By the way if you live in either Miamai, Florida or the greater Miami area and when you or a family member is charged with a criminal offense it takes the expertise of Miami criminal attorney to ensure the case is prepared to your advantage because it can mean your very freedom. David Garvin is simply one of the best miami criminal attorney out there.
There was an earlier conviction in March where Lincoln was charged with attempted murder along with other charges, along with a co-defendant, Lawrence Doty, who was found not guilty of the same incident.
According to Lincoln’s attorney in this March case a witness identified as Sharon Coelho testified and while she was the one who had planned the crime she was granted immunity in lieu of her testimony. It was testified that Doty had more blood on him and was more violent during the crime and he was found not guilty. Lincoln was convicted of the crime.

There was also an incident where Lincoln was sentenced 242 years for shooting at deputies that occurred in Mesa County. An incident that included a stabbing where he stabbed a man six times in the desert, along with armed robbery and other charges.
He has also an incident in Grand Junction where in a high speed chase Lincoln reached speeds of 100 miles per hour and shot at deputies 23 times.
Lincoln’s attorney has said there are several appeals filed and that she believes that he is innocent of certain crimes and an innocent man is going to jail. Gourdy also stated that there is some evidence that is very strong that could win new trials for approximately three of Lincoln’s cases.

The power of Colostrum and it’s effect on Immunity

Colostrum is known to create transfer factor in the body which in return helps build up the body’s immunity to remember certain illnesses.

Transfer factor is a theory that immunity information in the body can be transferred from cell to cell.  A cell has the ability to teach the immune system to recognize bacteria and viruses that are harmful to the body.  As this is the primary job of the immune system to recognize harmful bacteria and viruses and then fight them.  The body has the ability to effectively defend against bacteria, fungus, and other diseases.  The transfer factor molecules create a memory in the body of the past pathogens it has been exposed to, which is integral to maintain the integrity and effectiveness of the immune system.

Colostrum is produced from the mammary glands of all mammals late during pregnancy or directly after giving birth.  It is high in carbohydrates, protein, and antibodies.  It is also low in fat because it is difficult for newborns to digest fat because of their small digestive systems.  It acts in delivering nutrients in a low volume but highly concentrated.  There is also a mild laxative associated with it that helps a newborn pass their first stool and rid of the waste of dead red blood cells due to birth.  Colostrum contains immunoglobulin assisting with the prevention of jaundice and it helps to create physical strength and build up the general immune system.

As colostrum helps build the body’s initial immunity it also builds the initial memory of the immune system.  Transfer factors are made up of tiny molecules of protein produced by immune cells in the body called T cells.  The transfer factors are what allow the immune system to remember the conditions for which the body has become immune to and established.

A good example of the way transfer factors work is like the chickenpox during childhood.  When a child is infected and treated the body develops a memory of the illness.  This memory prevents the body from being re-infected later in life.  The body will have a transfer factor molecule specifically for chicken pox and this molecule is an exact blueprint of what the disease looks like.  This allows the body to immediately recognize and respond to any type of re-infection or exposure.

Scientists have begun working on creating additional transfer factor for human consumption in an effort to strengthen immune systems even further.  The way they are doing this is by working with colostrum from cows.  This is because a healthy cow has the ability to produce millions of different transfer factors.  However, when a cow is exposed to a pathogen then it produces another transfer factor creating a blueprint of the specific virus.

It is said that transfer factors can cross different mammal lines.  For instance, a human can be given a cow’s transfer factors.  If these transfer factors have created blueprints of different pathogens then the human will immediately have the immunity to those pathogens as if they were already exposed themselves.

Colostrum is responsible for building the body’s initial transfer factor and immune system.  By creating transfer factors in other mammals, scientists are able to give these to humans building stronger immune systems in humans.

Future Predictions for an Information Era

I recently read a superb book called ‘The Sovereign Individual’.
I wanted to read it because Robert Kiysaki had listed it as an influential or important book in one of his own books. One of the writers of this book is Lord Reese-Mogg, who specializes in global long range investments and thus makes predictions accordingly
that can impact how one should invest. One of his principal points is that there is a big shift about every five hundred years in Western civilization which has major repurcussions the world over.
Just as in the 1492 marks the official beginning of the industrial age, 1992, the year the world wide web went truly wide, is the official start of the information age.
According to Mogg, this transistion will be much more pronounced even than the shift to the agrarian or industrial age since microprocessing will have a more world-altering impact on human society over time. He also states that by the year 2040  world will look radically different than
it does now as many industrial age institutions change drastically out of necessity, much as the church did at the start of the industrial age. All in all,  Mogg says huge changes are inevitable. Just like changes made from the invention of the printing press during the industrial age could not really be halted once they got going,
so too will the shifts from microprocessing be. He and his co-writer aslo made the insightful point that, during the early stages of these types of these epic transitions, those on the edge rarely realize how severe the changes will be.
At the time the first printing press was invented, for instance, the church had a total monopoly on the making of books such as the Bible. It was time-consuming work that required a high degree of skill. Not many people actually understood then the full ramifications that this seemingly benign invention would have. The Church quickly declined in power. Very soon manuals could be reproduced in many different localities.  A factory which produced an industrial product in Britain could quickly be duplicated in Italy, the U.S. or Germany. Instruction manuals could be easily made universal across the continents. Very soon the standard of living of the advanced nations went up massively. Low skill workers could now move to urban areas and earn a wage far above their usual pittance. The Feudal era was dominated by different town guilds in which a few skilled individuals dominated certain crafts such as hat-making shoemaking and
commanded large incomes. But quickly the unskilled workers could go to a factory and earn a wage well above the subsistence level.
Now we are at the beginning of a similar transistion…….. The changes of this shift will indeed be huge, particularly as the cost of wireless networks continues to go down. I suggest that you brace your self because it will be a roller coaster ride for sure. Some folks will gain from it, others that cling to outdated ideas will lose status, unfortunately.

In general, folks who cling to or relay on industrial era benefits such as a lifetime pension or medicare will suffer the most. Many will drop out of the middle class over time, it would seem.
Entrepreneurs such as Bill Gates, however will get richer at an ever younger age.  It will be a wild time in that respect, according to Mogg.
Is there anything to be wary of in this new information driven economy? Well we have to be beware of mega-mergers perhaps more than ever. If we get to a point where, say, ninety percent of all purchases are made online, and the big search portals then merge, it
will be easier than ever for the big companies to monopolize the marketplace, since most people tend to find things via a handful of search engines now. What can you do to prepare. You may consider an information age home based business like Freelife International or something similiar instead of clinging to deceptive job security.

Automakers and the Air Resources Board

California’s hydrogen suppliers along with automakers met with the Air Resources Board on Thursday January 10th.

This meeting was to come to an agreement to open a group of fueling stations for auto owners of non-polluting fuel cell powered autos to refuel on the highway.

One fueling station that was recently closed will reopen as an agreement with energy companies that were present at the meeting who agreed to supply the needed money and staff to reopen this station.

Six energy companies previously operated this station that will be reopened, however the lease they held ended on December 31st, 2007 and there was not a new agreement put in place.  By the way, if you live in California, have been in a car accident and need a good accident attorney Los Angeles then you are advised to take a serious look at the Law Offices of Steven Sweat. There you can find a more than competent Los Angeles Car  Accident Attorney or dui lawyer Santa Monica. The lawyers there can also help you if you have suffered injuries such as electrocution, burns, elder abuse or an amusement park accident of some sort. They come highly recommended. Well, back to the news story….

According to Mary Nichols a member of the Air Resources Board, this will be just the beginning of these stations; they intend to open more of these stations. They plan to reissue bids in the near future for the upgrade of existing stations and construction of new stations.

The Air Resources Board has $7.7 million dollars in place for these proposed projects that they will be taking bids, along with and additional $6 million dollars that they have requested from Governor Arnold Schwarzenegger upcoming budget to complete their plan of constructing and opening more of these stations.

You Talkin’ To Me?

I recently finished reading a great book about the career of top movie actor Robert De Niro.
Man what a career! And what a disciplined guy. His work ethic and approach has really inspired me in other areas of my life, since I myself am not an actor.
He would always say that “You have to earn the right to Play a Role” or something to that effect. For a role such as his Oscar Winning performance in ‘Raging Bull’
that meant not only working closely with the real life middle weight champion Jake Lamotta but also becoming a boxer himself. He became very good, winning most of his fights. Lamotta claimed he would have been among the top
20 middleweights if he had become a professional. He became so good that he was dangerous, breaking Joe Pesci’s ribs
during the filming despite Joe wearing a thick vest. One funny thing happened involving director Martin Scorsese, who could not stand blood. De Nero, when training during real fights,
yelled at Scorsese as he was leaving “where are you going? Stay here! I am doing this for you, you know!”. He apparently wqas forced to watch the carnage.

My personal favorite Robert De Nero films include ‘Heat’ in which he plays an ace thief. Co-stars include Al Pacino, Val Kilmer, Jon Voight, Diane Venora and Ton Loc, among several others.
I also liked him as Al Capone in the classic 1987 thriller ‘The Untouchables’ which co-starred Andy Garcia, Kevin Costner, Sean Connery and Marcia Gay-Harden. Directed by Brian De Palma.
I also thought ‘Were No Angels’ was cool. This 1989 film co-starred Sean Pean, Demi Moore and John C. Reilly. Him and Penn play escaped convicts on the run, posing as catholic priests.
I liked ‘Cape Fear’. he played criminal Max Cady in a tour-de force performance. According to the book his preperation for this role was incredible. he was nominated for best actor for it in 1991.
Co-stars include Nick Nolte, Jessica Lange, Juliette Lewis, Robert Mitchum and Gregory Peck.
He was also nominated for best actor for the 1990 flick ‘The Awakenings’ which co-starred Robin Williams,
the 1978 Vietnam War flick ‘The Deer Hunter’ which co-starred Meryl Streep and Christopher Walken, and he won an oscar for best supporting actor
for his brilliant work in the 1974 blockbuster ‘The Godfather part 2′
He also got major kudos for his work opposite Jeremy Irons in ‘The Mission’, Terry Gilliams science fiction film ‘Brazil’,
and ‘Casino’ opposite Sharon Stone and Joe Pesci. Of and Goodfellas and ‘Mean Streets’ as well, both directed by Martin Scorsese.
Robert De Niro has also directed 2 films: ‘A Bronx Tale’ and the recent Matt Damon & Angelina Jolie thriller ‘The Good Shepard’

Apple will now allow 3rd-party iPhone applications

Filed under: Internet News, National News, Technology News — Tags: — @ 8:17 am

In an AP story from new York as reported by yahoo news it was announced
that the Apple Corporation will permit 3rd-party applications on the iPhone, according to CEO Steve Jobs.
Jobs made this announcement on the company website today.
In a decision which marks a very decisive about-face from the firm’s past wish of controlling the applications that the users have on their handheld device’s,
Jobs stated that they want to release a software
development kit in several months which will permit individuals outside the firm to create iPhone as well as iPod touch applications.
he was quoted as saying: “We are excited about creating a vibrant third-party developer community around the iPhone and enabling hundreds of new applications for our users,”
Designers have already constructed many iPhone applications which run their Safari Web browser since they did notoriginally open the iPhone directly to 3rd-party software development.
The iPhone, which combines a cellular telephone and wireless web access all together ina  single hand held device, was released some towmonths ago with much hype and high expectations.
To date, the firm has sold more than one million iPhones.
The CEO stated today that it will take a few months to release the kit since the firm wishes to give developers an open platform while at the same time protecting users from various viruses and malware, etc.
That sounds reasonable enouph to me…
He was quoted as saying: “There have been serious viruses on other mobile phones already, including some that silently spread from phone to phone over the cell network,” he wrote.
It was also recently repiorted by the AP that many cell
phone and PDA users have been reporting that they sometimes feel odd vibrations when there are none.
This rather odd phenomenon is often referred to as ‘Phantom Vibrations’ and no one seems to know exactly what is causing it.

Arrested man apparently fed live cats to dog

In possibly the most horrific pet news since the Michael Vick story broke, Georgia authorities claim that Tye Hilmo, 21, of Dacula trapped neighborhood cats and fed them to his pit bull. The Georgia Police Department charged Hilmo with aggravated animal cruelty. This is a felony which carries a sentence of 1-5 years in jail and a substantial fine as well.
He has been in the Gwinnett County Jail, with no bond permitted, since deputies searched his house on September 10. They found 2 lbs of marijuana, a few firearms plus 2 feline bodies in his yard, according to police.
In addition, his  mobile telephone had a grisly picture of a canine eating a kitten above a line that reads, “Good dog”, the report states.
At first, the Police officers assigned to the case charged the suspect with some offenses pertaining to the guns and narcotics. But they then tacked on the cruelty to animals charges 2 days ago. It should be noted, however, that some of his neighbors are a bit skeptical of the latter charges.
“He drinks and he is loud…… no question about that,” said Tim Johnson, 31, a neighbor. But he stated that Hilmo really adored animals. He stated that he found these charges “really hard to believe.”
Samson and stepdaughter Ashley McIlvainey, 18, said they are not sure that Hilmo is to blame.

Insects may hurt cat health

The scourges of heat combined with humidity have brought with them a plethera of mosquitoes to Tulsa, oklahoma and it is not just humans who are fighting these aweful critters.

Cats, for instance, might face the dreaded heartworm after being bitten by mosquitos.

The signs to look for might not show for a few months or even years, as the sheer numbers of heartworms often accumulates rather gradually.

Like cats, dogs might show no early signs of heartworms, while severely infected animals might show signs which include a cough, low energy levels, lowered appetite and also weight loss.

Heartworms in dogs are eliminated by a drug known as adulticide, that is injected into a muscle in a sequence of treatments. However, there are no products are approved for the treatment of heartworms in cats in the US at this time, unfortunately.

The risk of reinfection during treatment is eliminated by using a heartworm preventive.

The mosquito picks up microfilaria while it is feeding on the blood from an infected animal such as a feline.
It is live for some 2 weeks in the salivary glands of a mosquito. The mosquito bites another animal and releases the heartworm larvae into the wound and ultimately the bloodstream.
